Definitions

Services -	Describes prepaid items of labour and/or facility provide by Aspire Media Design and/or the provision of such items
Customer -	Recipient upon purchase of any of the hereinto referred Services

Server Use
Aspire Media Design reserves the discretionary right to refuse service and/or access to its servers.

Aspire Media Design do not allow any of the following content to be stored on its servers:

Illegal Material -	Includes copyrighted works, commercial audio, video, or music files, and any material in violation of any International, National or Local regulation.
Adult Material -	Includes all pornography, erotic images, or otherwise lewd or obscene content. Aspire Media Design reserve the right to designate "adult material".
Warez -	Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Support
We will endeavour to provide sustained high quality service, including provision of Services, and resolution of technical issues arising from the provision of afforementioned Services. If you experience problems with Services provided by Aspire Media Design please refer to our online FAQ page, or contact our support team using any of the available contact options.

Payment
All Services are provided on a prepay basis, excluding only webdesign services (Website Solutions) whereby a deposit payment (Advance) of 50% is payable in advance and the balance payable upon receipt. Aspire Media Design reserves the right to request additional Advances prior to completion of any Website Solution in the event of unusually long delays generated by the Customer. In this event the additional Advance will not exceed the value of the work complete at that point.
Although Aspire Media Design reserves the right to modify pricing at it's discretion, all pricing is fixed during the prepaid period. Upon completion of any prepaid period a renewal of that period at the current published rate is assumed, and invoiced approximately 30 days prior to the conclusion of the current period. Payment for the renewal period is due prior to the seventh day of the renewal period.

All invoices will automatically be sent to the Customer in via email, and made available via Client Admin at http://www.aspiremediadesign.co.uk. To obtain alternative invoice options please contact us.

All invoices are published in UK Pounds Sterling (GBP).

Currently available payment options include;

Credit/Debit Card -	All major Credit/Debit cards accepted
Cheque/Postal Order -	Crossed and made payable to 'Aspire Media Design'
Online Banking (Balance Transfer) -	Transfer funds directly from your own bank account

Cancellation and Refunds
Aspire Media Design reserves the right to cancel any and all Services at any time with appropriate reason. In this event the Customer will be entitled to an appropriate refund. The Customer will not be entitled to a refund in the event of breach of these Terms and Conditions, or breach of any of Aspire Media Designs Policies, by the Customer.
The Customer may cancel their receipt of Services at any time with 7 days notice. Any incentives offered to the Customer when opening the account will also be cancelled.

Responsibilities
Despite the regular Server backup performed, the Customer understands and agrees that Aspire Media Design and/or its representatives are not responsible for any loss of software or data. The Customer is solely responsible for the backup and retrieval of software and/or data in any event and at all times.
It is the Customers responsibility to ensure that invoices for any and all Services are paid on or before the date due. In the event of non-payment of aforementioned invoices Aspire Media Design reserves the right to suspend any and all Services until the outstanding balance is paid in full.

Prohibitions
The resale of any and all Services provided to the Customer by Aspire Media Design is strictly prohibited. The Customer is liable for any and all costs arising from such action, including administrative costs imposed by Aspire Media Design.
The Customer is prohibited from acting, with or without intent, in any manner that compromises the ability of Aspire Media Design to provide the herein defined Services or any other commitment, either to the Customer or any other party.

Indemnification
The Customer agrees that it shall defend, indemnify, save and hold Aspire Media Design harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Aspire Media Design, its agents, officers and/or employees, that may arise or result from any of it's Services provided or performed or agreed to be performed by Aspire Media Design, its agents, officers and/or employees. The Customer agrees to defend, indemnify and hold harmless Aspire Media Design against liabilities arising out of; (1) any injury to person or property caused by any Services sold or otherwise distributed by or in connection with Aspire Media Design; (2) any material supplied by the Customer infringing or allegedly infringing on the proprietary rights of any third party; (3) copyright infringement by the Customer.

Disclaimer
Aspire Media Design will not be responsible for any damages suffered by the Customer. Aspire Media Design makes no warranties of any kind, expressed or implied for Services. Aspire Media Design disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Aspire Media Design, its agents, officers and/or employees, or any other third party.
Aspire Media Design reserves the right to revise its policies at any time.

Dispute
Any dispute between Aspire Media Design and the Customer arising from Aspire Media Designs General Terms and Conditions and/or policies shall be subject to English Law.
